Terms of Service for iShackShare.com
Last Updated: October 26, 2026 Version: terms-2026-10-26 — recorded against every acceptance, see §19
1. Acceptance of Terms
By accessing or using iShackShare.com (the "Site"), you ("User," "you," or "your") agree to be bound by these Terms of Use (the "Terms") and any additional rules, policies, guidelines, or supplemental provider terms posted on the Site and applicable to you.
These Terms constitute a legally binding agreement between you and ShackShare LLC ("ShackShare," "we," "us," or "our"). If you do not agree to these Terms, you must not use the Site.
2. Description of the Platform
iShackShare.com is an online marketplace that enables individuals ("Hosts") to list ice shacks, ice camping sites, and similar recreational accommodations for short-term rental, and enables other individuals ("Guests" or "Renters") to browse, book, and rent such listings.
Three separate relationships. These Terms concern three distinct relationships, and it matters which one is in question:
- Host ↔ Guest. The rental itself. The agreement to occupy and use an accommodation is made directly between the Host and the Guest. ShackShare is not a party to that agreement.
- User ↔ ShackShare. We provide marketplace and platform services — listing, discovery, booking mechanics, messaging, and support tooling.
- Payments. Payment processing and facilitation occur through Stripe Connect or another designated payment processor, subject to that processor's own systems and terms.
Hosts are independent providers. ShackShare is not the owner, operator, lessor, guide, resort, campground, or provider of any listed accommodation or service. Nothing about our marketplace or payment role makes ShackShare a party to the underlying rental or service contract.
Listing review is not certification. ShackShare may review or screen listings for platform legitimacy, completeness, compliance with our rules, fraud prevention, or marketplace standards. Any such review is not a representation, warranty, inspection, approval, or certification of safety, legality, condition, quality, suitability, regulatory compliance, ice conditions, access, or accuracy. Hosts remain solely responsible for their listing and their property under Section 4.
3. Eligibility and User Representations
You represent and warrant that:
- You are at least eighteen (18) years of age;
- You have the legal authority to enter into these Terms;
- The information you provide is accurate and kept current;
- Your use of the Site will comply with all applicable federal, state, county, municipal, and local laws, regulations, ordinances, and rules.
4. Host Responsibilities and Regulatory Compliance
Hosts acknowledge and agree that they act as independent providers of rental accommodations and related services and are solely responsible for ensuring that their listings, rental properties, services, and rental activities comply with all applicable federal, state, county, municipal, tribal, and local laws, regulations, ordinances, codes, and rules, whether now in effect or later enacted.
Without limitation, Hosts are solely responsible for compliance with all requirements relating to:
- Zoning, land use, ice-access, and occupancy laws;
- Licensing, registration, and permit requirements;
- Health, safety, and equipment standards, including heating appliances and ventilation;
- Removal of structures from the ice as required by state or local authority;
- Insurance requirements;
- Accessibility requirements, if applicable; and
- Consumer protection and disclosure obligations.
Insurance and licensing requirements specific to a provider category — guiding, resort operation, ice campgrounds — are set out in the applicable Supplemental Provider Terms under Section 21. This Section states the general obligation; that one states what a particular role requires.
Listing accuracy. Hosts are responsible for the accuracy of every listing, including its location, sleeping capacity, fishing capacity, rates, amenities, equipment provided, services offered, any rules the Host imposes, and any stated security deposit. Listings default to showing an approximate location publicly; the exact location is released to a Guest once a booking is confirmed. Hosts may choose to show an exact location instead.
Our review does not relieve the Host. Where ShackShare has reviewed, approved, or published a listing, that does not transfer any of the responsibilities in this Section to ShackShare.
5. Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us promptly of any unauthorized use. We may suspend or terminate an account under Section 18.
6. Taxes
Sales tax. ShackShare calculates, collects, and remits sales tax on bookings in jurisdictions where we are registered. The tax is shown to the Guest before payment.
Local, municipal, room, and resort taxes. Some municipalities impose an additional tax on short-term stays. These are set locally and vary town by town. Where such a tax applies to a listing:
- the Host declares the applicable rate when building or editing the listing;
- ShackShare charges it to the Guest at checkout as its own line, separately from sales tax;
- the amount collected is paid out to the Host together with the Host's share; and
- the Host is responsible for remitting it to the relevant municipality or authority, and for registering where registration is required.
ShackShare has given Hosts the means to collect such a tax. Any liability, assessment, penalty, or interest arising from a Host's failure to declare, remit, or register is the Host's own.
Other taxes. Hosts are responsible for all other taxes on their rental income, including income tax. A Host may not ask a Guest to pay any tax or fee directly that was not charged through the Site.
Tax rules vary by jurisdiction and change. ShackShare gives no tax advice and makes no warranty of tax compliance. Hosts indemnify ShackShare against claims arising from their own tax obligations.
7. Bookings, Payment, and Fees
Service fee. ShackShare charges a service fee of ten percent (10%) of the booking subtotal. The Host receives the remaining ninety percent (90%) of the subtotal. Add-ons and guide fees, where offered, form part of the subtotal. Taxes and security deposits are additional and form no part of the subtotal, of the Host's ninety percent, or of ShackShare's fee. Where a Host has declared a local, municipal, room or resort tax under Section 6, that amount is charged to the Guest as its own line, no service fee is taken on it, and it is passed to the Host with their payout for the Host to remit.
Payment Processing Fee. A non-refundable Payment Processing Fee of approximately three percent (3%) is applied to all Guest bookings to cover third-party transaction and payment processing costs. This fee is subject to applicable taxes. If a Guest cancels a booking, the Payment Processing Fee is retained by ShackShare and is strictly non-refundable. If a Host cancels a booking, the Payment Processing Fee will be fully refunded to the Guest. This fee is separate from the standard service fee and does not affect or reduce the Host's ninety percent (90%) payout.
Request to book. Most listings require Host approval. When a Guest requests a booking, the Guest's payment method is authorized but not charged. The Host has twenty-four (24) hours to approve or decline; if the Host does neither, the request expires and the authorization is released. The Guest's card is charged only when the Host approves. A pending request does not reserve the dates.
Instant booking. Some listings accept bookings without Host approval. On those, payment is taken at the time of booking.
Payment credentials are held by the processor, not by us. Card and payment credentials are stored and handled by Stripe, or another designated payment processor, subject to that processor's systems and terms. ShackShare does not store your card number.
Authorization to charge. By booking, you authorise ShackShare to initiate, through the processor, charges permitted under these Terms — the booking itself, any disclosed security deposit, refunds, reversals, corrections, and any other amount authorized under these Terms. You may view and remove saved payment methods in your account at any time; removing one does not affect a booking already confirmed against it.
Currency and authority. All amounts are in US dollars. You represent that you are authorized to use the payment method you provide.
8. Cancellations and Refunds
Each listing carries one of three cancellation policies, shown to the Guest before booking. The policy that applies to a booking is the one in effect at the time that booking was made.
| Policy | Guest cancels |
|---|---|
| Flexible | Full refund if cancelled at least 24 hours before check-in. |
| Moderate | Full refund up to 5 days before check-in; 50% up to 24 hours before; non-refundable thereafter. |
| Strict | 50% refund up to 7 days before check-in; non-refundable thereafter. |
Security deposits on cancellation. A deposit is not a payment for the stay and does not follow the rental refund schedule. What happens to it depends on who cancelled:
- If the Host cancels, the Guest's security deposit is returned in full.
- If the Guest cancels, the deposit is handled under the cancellation and deposit terms disclosed for that booking (Section 9).
In neither case does the rental refund percentage apply to the deposit.
If the Host cancels. A Guest whose confirmed booking is cancelled by the Host receives a full refund, regardless of the listing's cancellation policy. A Host who cancels confirmed bookings repeatedly may be removed from the Site under Section 18.
Refund timing and method. Refunds are issued to the original payment method. Settlement times are set by the card issuer and are typically five to ten business days.
Tax on a refund. Where a booking is refunded in full, the sales tax collected on it is returned with it.
Conditions outside anyone's control. Neither ShackShare nor a Host guarantees ice conditions, weather, or access. A Host may cancel and refund in full where conditions make a stay unsafe; nothing in this Section requires a Host to honor a booking they judge unsafe.
9. Security Deposits
A listing may state a refundable security deposit. Where it does:
- The deposit amount is shown to the Guest before booking.
- It is collected with the booking, as its own line, separate from the rental subtotal and from tax.
- A deposit is not Host earnings. It is not part of the Host's share, forms no part of ShackShare's service fee, and is not paid out with rental proceeds.
- If the booking is cancelled, the deposit is handled under Section 8 — returned in full where the Host cancelled, and under the terms disclosed for that booking where the Guest did. The rental refund percentage never applies to it either way.
After the stay. Following the scheduled checkout:
- The Host may release the deposit in full at any time, and doing so is a single action.
- The Host has seven (7) calendar days from scheduled checkout to keep any part of the deposit.
- To keep any part, the Host must give a written reason, which the Guest will see. Photographs or other supporting evidence may be attached.
- Permitted grounds are damage, missing items, or cleaning beyond ordinary use. Ordinary wear and tear is not chargeable against a deposit.
- If the Host takes no action within those seven days, the full remaining deposit is automatically refunded to the Guest.
- ShackShare notifies the Guest either way, with the amount returned, any amount kept, and the Host's stated reason.
The decision is the Host's. The security deposit is processed and maintained through Stripe, or another designated payment processor, until it is released, paid, or refunded under this Section. ShackShare communicates the Host's instruction through the payment system, notifies the Guest, and maintains the transaction record. We are not the arbiter of whether damage occurred or what it was worth.
A Guest may ask us to review a kept deposit. Where a Host keeps any part of a deposit, the notice sent to the Guest includes a link to raise it with ShackShare. The Guest has seven (7) calendar days from that notice to do so, and may explain their position.
What this does and does not mean:
- Raising a deposit for review does not reverse the Host's decision and does not by itself return any money. The funds have already been released to the Host.
- ShackShare will read what the Guest sends, consider it alongside the Host's stated reason and any evidence, and follow it up. We may contact either party and may act under Section 18 where a Host's conduct warrants it.
- ShackShare gives no undertaking as to the outcome and remains not the arbiter of the underlying dispute.
- A Guest may pursue any remedy otherwise available to them, including in small claims court, whether or not they raise it with us, and nothing in this Section limits that.
Deposit handling is separate from Host payout (Section 10) and from ShackShare's commission.
10. Host Payouts and Payout Onboarding
Payout onboarding is required to accept bookings. A Host may create an account and build a listing without connecting a payout account. That listing cannot accept bookings or booking requests until the Host has completed Stripe Connect onboarding. ShackShare does not hold Host earnings on a Host's behalf pending onboarding, and does not accrue a balance for a Host who has not onboarded.
Payout happens after the stay, not at booking. A Host's share is released when the reservation is completed:
- The Host marks the reservation complete once their Guest has departed; or
- If the Host does not, the system completes it automatically seven (7) days after scheduled checkout.
Payout is then initiated through the payment processor. Settlement timing is the processor's.
Security deposits are not part of Host payout. Where a Host keeps part of a deposit under Section 9, that amount is paid separately and may arrive at a different time from the rental share.
10A. Amounts Owed to ShackShare
Where an amount becomes owed to ShackShare — including through chargebacks, fraud, refunds, payment reversals, duplicate or incorrect payments, corrections, platform fees, or any other amount properly owed under these Terms — ShackShare may recover it by any of the following, in this order, subject to applicable law and the permissions of the payment processor:
- Offset against amounts otherwise payable to you;
- Withhold future amounts otherwise payable to you;
- Reverse a payment where reversal is available;
- Debit an authorized connected account or payment method, where permitted;
- Invoice you directly; and
- Collections or legal recovery.
Use of any one of these remedies does not waive the others.
11. Platform Integrity — No Circumvention
ShackShare is not exclusive. Nothing in this Section requires a Host to list only on ShackShare. Hosts may advertise and accept bookings through their own website, social media, Facebook Marketplace, other online travel agencies, or any other independent channel, and are encouraged to share their ShackShare listing link in their own advertising.
What this Section is about is a booking that came from ShackShare being moved off it. Where a prospective Guest first discovers, contacts, or requests a booking from a Host through the Site, the Host and Guest may not move that transaction off the Site for the purpose of avoiding ShackShare's fees, payment processing, or marketplace protections.
Accordingly, in relation to a lead, inquiry, or booking that originated on the Site, you agree that you will not:
- solicit or accept payment for it outside the Site;
- direct, invite, or encourage the other User to complete it off the Site;
- share or solicit phone numbers, email addresses, external links, or other contact details for the purpose of arranging it off the Site, before the booking is confirmed; or
- create duplicate or misleading accounts.
ShackShare may automatically screen messages sent through the Site for contact details and may redact them, flag them for review, or withhold them. Circumvention is grounds for immediate removal from the Site under Section 18, and for withholding of fees related to the circumvented booking.
12. User Conduct
You agree not to use the Site to harass, threaten, defraud, or discriminate against any person; to post false, misleading, or infringing content; to interfere with the operation or security of the Site; or to use the Site for any unlawful purpose.
Guest Responsibilities
The Guest who makes a booking is responsible for their whole party, and for the following:
- following the Host's rules, the stated occupancy limit, and all applicable laws;
- supervising any minors in the party;
- reporting the number of guests accurately;
- using heaters, generators, augers, vehicles, and any other equipment according to the Host's instructions and the manufacturer's;
- not moving or tampering with a shack unless the Host has permitted it;
- stopping use of any equipment or structure that appears unsafe, and telling the Host;
- damage caused by anyone in their party;
- holding any fishing licenses or permits required of them; and
- observing ice conditions and any access, resort, or authority restrictions that apply.
13. Content and Intellectual Property
You retain ownership of content you submit. By submitting content you grant ShackShare a non-exclusive, worldwide, royalty-free license to host, display, reproduce, and distribute it for the purpose of operating and promoting the Site. You represent that you hold the rights necessary to grant that license.
The Site itself, its design, and its content other than User content are the property of ShackShare and protected by applicable law.
14. Reviews
Reviews go both ways. After a completed booking, the Guest may review the Host and the listing, and the Host may review the Guest.
The two are not published the same way, and the difference is deliberate:
- A Guest's review of a listing appears publicly on that listing.
- A Host's review of a Guest is not public. It is visible to Hosts considering a booking request from that Guest, and to ShackShare. A note about a named person is not something we publish.
Reviews must be honest and based on a genuine experience. ShackShare may remove a review that violates these Terms. ShackShare is not obliged to remove a review merely because its subject disagrees with it.
15. Disclaimers
THE SITE, ALL LISTINGS, AND ALL CONTENT AND SERVICES ARE PROVIDED ON AN "AS IS," "AS AVAILABLE," AND "WITH ALL FAULTS" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SHACKSHARE DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, QUIET ENJOYMENT, AND NON-INFRINGEMENT.
SHACKSHARE DOES NOT WARRANT OR GUARANTEE:
- THE SAFETY, LEGALITY, QUALITY, CONDITION, OR SUITABILITY OF ANY LISTING OR RENTAL PROPERTY;
- THE ACCURACY OR COMPLETENESS OF ANY LISTING INFORMATION, INCLUDING ITS LOCATION;
- THE THICKNESS, STABILITY, OR SAFETY OF ANY ICE, OR THE SAFETY OF ANY ROUTE TO OR FROM A LISTING;
- THE CONDUCT, ACTS, OR OMISSIONS OF ANY HOST, GUEST, OR THIRD PARTY;
- THAT USE OF THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
ANY REVIEW OR SCREENING OF A LISTING BY SHACKSHARE UNDER SECTION 2 IS NOT A CERTIFICATION OF ANY OF THE ABOVE.
USERS ACKNOWLEDGE THAT OUTDOOR AND RECREATIONAL ACTIVITIES, INCLUDING ICE FISHING AND USE OF ICE SHACKS, INVOLVE INHERENT RISKS OF SERIOUS INJURY, DEATH, AND PROPERTY DAMAGE, INCLUDING WITHOUT LIMITATION FALLING THROUGH ICE, DROWNING, HYPOTHERMIA, CARBON MONOXIDE POISONING, FIRE, AND VEHICLE LOSS. USERS VOLUNTARILY ASSUME ALL SUCH RISKS.
16. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL SHACKSHARE LLC OR ITS MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR PERSONAL INJURY, WRONGFUL DEATH, PROPERTY DAMAGE, LOSS OF PROFITS, LOSS OF REVENUE, LOSS OF DATA, BUSINESS INTERRUPTION, OR EMOTIONAL DISTRESS, ARISING OUT OF OR RELATED TO:
- USE OF OR INABILITY TO USE THE SITE;
- ANY LISTING, BOOKING, OR RENTAL;
- ANY ACTS OR OMISSIONS OF HOSTS, GUESTS, OR THIRD PARTIES;
- CONDITIONS OF ICE, WEATHER, WATER, OR NATURAL ENVIRONMENTS;
- ANY DISPUTE BETWEEN HOSTS AND GUESTS.
SUBJECT TO THE FOLLOWING PARAGRAPH, SHACKSHARE'S TOTAL AGGREGATE LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE GREATER OF (A) ONE HUNDRED DOLLARS ($100) OR (B) THE SHACKSHARE SERVICE FEES PAID FOR THE TRANSACTION GIVING RISE TO THE CLAIM.
NOTHING IN THIS SECTION LIMITS SHACKSHARE'S OBLIGATION TO REMIT FUNDS IT IS ACTUALLY OBLIGED TO REMIT — INCLUDING A HOST'S PAYOUT UNDER SECTION 10, A SECURITY DEPOSIT UNDER SECTION 9, OR A REFUND OWED UNDER SECTION 8 — NOR DOES IT LIMIT ANY LIABILITY THAT CANNOT BE LIMITED OR EXCLUDED UNDER APPLICABLE LAW.
17. Indemnification
You agree to defend, indemnify, and hold harmless ShackShare LLC and its members, managers, officers, employees, agents, affiliates, successors, and assigns from and against any and all claims, demands, actions, causes of action, liabilities, damages, losses, judgments, penalties, fines, costs, and expenses (including reasonable attorneys' fees and court costs) arising out of or related to:
- Your use of or access to the Site;
- Your listing, booking, operation, maintenance, or use of a rental property;
- Any actual or alleged violation of law, regulation, or ordinance;
- Any tax assessment, audit, or enforcement action;
- Any injury, death, property damage, or loss occurring at or in connection with a rental;
- Any breach of these Terms or representations made herein.
This indemnification obligation shall survive termination of these Terms and your use of the Site.
18. Termination
ShackShare may suspend or terminate your access to the Site at any time, with or without notice, for any reason, including violation of these Terms. Grounds include circumvention under Section 11 and repeated Host cancellation.
Termination does not extinguish ShackShare's obligation to remit a Host payout already earned under Section 10, to return a security deposit under Section 9, or to issue a refund owed under Section 8; nor a User's obligation to honor bookings already confirmed, except where a cancellation or suspension is permitted under these Terms — including for safety, fraud, a Host's removal from the Site, or any other exception these Terms allow.
Sections that by their nature should survive termination shall survive, including but not limited to Sections 9, 10, 10A, 13, and 15–17 and 20.
19. Changes to Terms, and Records of Acceptance
ShackShare may modify these Terms. Each version of these Terms carries a version identifier.
How you accept. Before completing a booking you are asked to tick a box confirming that you agree to these Terms, the applicable cancellation policy and the liability waiver, each linked from that box. A booking cannot be completed without it.
We record your acceptance. When you accept these Terms or any supplemental provider terms, ShackShare records the version accepted, the date and time, your user identifier or email address, the network address and device the acceptance came from, and the relevant booking, listing, or provider-role context where applicable.
An email address is recorded alongside the user identifier because a Guest may book without creating an account, and a record that could not name that person would be missing exactly the acceptance most likely to be questioned.
A supplemental provider role is accepted separately. Where a Host activates a role governed by Supplemental Provider Terms under Section 21, that acceptance is collected and recorded in its own right, against that document and its own version — not inferred from having accepted these Terms. These records are retained so they can be retrieved for support, dispute, and compliance purposes.
Material changes require acceptance, and continued use alone is not acceptance of a material change.
Booking-specific rules stay fixed. The cancellation policy, service fee, and deposit terms applicable to a confirmed booking are those in effect when that booking was made, regardless of any later change to these Terms.
20. Disputes Between You and ShackShare
This Section concerns disputes between a User and ShackShare. It does not apply to a dispute between a Host and a Guest, including a disagreement about a security deposit — those are addressed in Section 9.
Notice and informal resolution. Before starting arbitration or litigation, you agree to give ShackShare written notice describing the dispute and the relief sought, at the address in Section 23, and to allow thirty (30) days for informal resolution. This requirement does not apply where it is not legally required, or where urgent injunctive relief is sought.
Individual arbitration. Where enforceable, any dispute not resolved informally shall be resolved by binding individual arbitration rather than in court.
Small claims. Either party may instead bring an individual claim in small claims court, if the claim qualifies.
No class actions. To the extent permitted by law, disputes will be brought only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding.
If any part of this Section is found unenforceable, the remainder continues to apply, and any claim that cannot be arbitrated proceeds in the courts named in Section 22.
21. Supplemental Provider Terms
Some providers offer services beyond a standard shack rental — including guides, resorts, and ice campgrounds, and other categories we may add.
Each such category has its own supplemental terms, published separately and individually versioned. A supplemental term applies to you only when you activate or use that role or service, and is accepted separately, with that acceptance recorded under Section 19. Supplemental terms do not apply to a User who does not use that role.
Where a supplemental term conflicts with these Terms, the supplemental term governs for that role or service only.
22. Governing Law and Venue
These Terms shall be governed by and construed in accordance with the laws of the State of Wisconsin, without regard to conflict-of-law principles. Subject to Section 20, any dispute shall be brought exclusively in the state or federal courts located in Wisconsin.
23. SMS Terms
What we text and when. ShackShare LLC sends booking notification text messages to hosts who ask for them: a text when a renter requests to book their shack, and a text when a booking is confirmed. We do not send marketing or promotional texts on this service, and we do not text renters.
How you opt in. Text alerts are off unless you turn them on. A host turns them on in their own ShackShare dashboard by entering a mobile number and switching on text alerts. Nothing is pre-selected, and agreeing to these Terms does not opt you into texts.
Frequency. Message frequency varies and depends on how often your shack is requested and booked.
Cost. Message and data rates may apply. ShackShare does not charge you for these messages; your mobile carrier may.
Stopping them. Reply STOP to any message to stop receiving them. We record the request and switch that number off. Reply HELP for support, or email info@ishackshare.com.
Your information. We do not sell or share your SMS opt-in data or personal information with third parties for marketing purposes.
Carriers. Carriers are not liable for delayed or undelivered messages.
24. Contact Information

By affirmatively accepting these Terms as described in Section 19, you acknowledge that you have read, understood, and agree to be bound by them.
